Please read these Terms carefully before using PT Pro. By creating an account or using our platform, you agree to be bound by these Terms. If you don't agree, please don't use PT Pro.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and PT Pro Pty Ltd ("PT Pro", "we", "us", "our"), governing your use of the PT Pro platform, website, mobile application and related services (collectively, the "Service").
By clicking "I agree", creating an account, or using the Service in any way, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them.
2. Description of Service
PT Pro is a software-as-a-service platform that enables personal trainers to:
- Create a public booking page for clients to schedule sessions
- Log and track client workouts, personal bests and body metrics
- Communicate with clients via in-app messaging
- Build and assign training programs
- Track revenue and manage their fitness business
We reserve the right to modify, suspend or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes.
3. Accounts & Registration
To use PT Pro, you must create an account by providing accurate, current and complete information. You are responsible for:
- Keeping your login credentials confidential
- All activity that occurs under your account
- Notifying us immediately if you suspect unauthorised access at [email protected]
You may not create accounts for others without their permission, use another person's account, or create multiple accounts to circumvent restrictions.
PT Pro accounts are personal to you and may not be transferred or sold.
4. Subscriptions & Billing
Plans
PT Pro offers the following subscription plans:
- Starter: Free, limited to 5 active clients
- Pro: $29 AUD per month, unlimited clients and full features
- Elite: $79 AUD per month, includes multi-trainer accounts and white-label branding
Billing
Paid plans are billed monthly on a recurring basis. Your subscription will automatically renew each month unless cancelled. By providing payment details, you authorise PT Pro to charge your payment method on each renewal date.
Taxes
All prices shown are in Australian Dollars (AUD) and exclusive of GST. GST of 10% will be added for Australian customers. International customers may be subject to local taxes.
Price changes
We may change subscription prices with at least 30 days' notice. You will be notified by email and may cancel before the new price takes effect.
Free trials
Pro and Elite plans include a 14-day free trial. No credit card is required to start. After the trial, you will be charged unless you cancel.
Promo codes
Promo codes grant free access to paid features for a specified duration. Codes are non-transferable, cannot be combined with other offers, and may be revoked at our discretion.
5. Cancellation & Refunds
Cancellation
You may cancel your subscription at any time from Settings → Plan & Billing. Cancellation takes effect at the end of your current billing period — you retain access until then.
Refunds
We do not offer refunds for partial months or unused time on paid subscriptions, except where required by Australian Consumer Law. If you experience a technical issue that prevents you from using the Service, contact [email protected] within 7 days and we will review your case.
Downgrade
Downgrading from a paid plan to Starter takes effect at the end of your billing cycle. Data beyond Starter limits (e.g. more than 5 clients) will become read-only but will not be deleted.
6. Acceptable Use
You agree not to use PT Pro to:
- Violate any applicable laws or regulations
- Store or transmit illegal, defamatory, harassing or abusive content
- Impersonate any person or entity
- Attempt to gain unauthorised access to any part of the Service
- Introduce malicious code, viruses or disruptive data
- Scrape, crawl or systematically copy content from the platform
- Resell or sublicense the Service without our written consent
- Use the Service in a way that could harm, overload or impair our infrastructure
- Provide false or misleading information to clients through the platform
Violation of these rules may result in immediate account termination without refund.
7. Your Content
You retain ownership of all content you create and upload to PT Pro, including client data, workout logs, session notes and training programs ("Your Content").
By uploading content, you grant PT Pro a limited, non-exclusive, worldwide licence to host, store, display and process Your Content solely for the purpose of providing the Service to you.
You represent and warrant that:
- You have all necessary rights to upload the content
- Your content does not infringe the intellectual property rights of any third party
- Your content does not violate any applicable laws
We do not claim ownership of Your Content and will not use it for any purpose beyond providing the Service.
8. Client Data & Responsibilities
As a personal trainer using PT Pro, you are responsible for:
- Obtaining appropriate consent from clients before storing their personal information on the platform
- Ensuring client data is accurate and up to date
- Complying with all applicable privacy laws in your jurisdiction when handling client data
- Having appropriate terms and privacy notices in place with your clients
- Not storing sensitive health information that requires a higher duty of care without appropriate qualifications and consent
PT Pro acts as a data processor on your behalf for the purpose of client data. You are the data controller. Please see our Privacy Policy for full details.
9. Intellectual Property
The PT Pro platform, including its design, code, branding, logos, copy and features, is owned by PT Pro Pty Ltd and protected by Australian and international intellectual property laws.
Nothing in these Terms grants you any right to use the PT Pro name, logo or brand without our prior written consent, except as necessary to use the Service.
Feedback, suggestions and ideas you submit to us may be used by PT Pro without obligation to you.
10. Limitation of Liability
To the maximum extent permitted by law, PT Pro shall not be liable for:
- Indirect, incidental, special, consequential or punitive damages
- Loss of revenue, profits, data or business opportunity
- Any claim arising from your reliance on the Service for medical, fitness or health advice
- Interruptions, errors or downtime in the Service
- Unauthorised access to or alteration of your data
Our total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to PT Pro in the 12 months preceding the claim.
Nothing in these Terms excludes liability for death, personal injury or fraud caused by our negligence, or any liability that cannot be excluded under Australian Consumer Law.
11. Indemnification
You agree to indemnify, defend and hold harmless PT Pro and its officers, directors, employees and agents from any claims, liabilities, damages, costs and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third party rights
- Your clients' claims arising from your use of the platform in your PT business
12. Termination
You may terminate your account at any time through Settings → Account → Delete Account.
We may suspend or terminate your account immediately, without notice or refund, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the platform or other users.
Upon termination:
- Your access to the Service ends immediately
- Your data is retained for 90 days and then permanently deleted (unless legal obligations require longer retention)
- You may request a data export within the 90-day window
13. Disputes & Governing Law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising out of or related to these Terms or the Service.
Before initiating any legal proceedings, you agree to contact us at [email protected] to attempt to resolve the dispute informally within 30 days.
Nothing in this section prevents you from making a complaint to the Australian Competition and Consumer Commission (ACCC) or the Australian Information Commissioner (OAIC).
14. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Send an email notification to all registered users
- Display a notice within the app
Your continued use of PT Pro after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must cancel your account before the changes take effect.
